TERMS OF SERVICE General 1. All prices are calculated in USD [$] 2. Rude or unsavory behavior on the part of the commissioner are grounds for cancellation. 3. Commissions work on a waitlist basis. As such, commissions that were given first will take priority, so on and so forth. 4. By ordering any work that is R-18, you are agreeing that you are 18 or older. 5. If any of the terms are violated, I reserve the rights to blacklist the commissioner and never take commissions from them ever again.Copyright 1. I, the artist, retain all rights to the original artwork. The commissioner is not allowed to use the artwork for anything other than personal use unless previously discussed and agreed upon. Commercial commissions are excluded from this rule. 2. As the owner of the artwork’s rights, I reserve the right to use it to promote myself, my sales, and my social media accounts, as well as the right to upload it wherever I see fit. Commercial commissions are excluded from this rule. 3. Purchasing commercial rights come with a 100% fee of the original price. This allows the commissioner to use the artwork in any way shape or form that they like, with some exceptions: a) Using your commissioned pieces as or for NFTs, cryptocurrency, or any other blockchain-based technologies. b) Using your commission in a way that will dishonor or disrespect the original artist. c) Claiming the artwork as your own. d) Removing the artwork’s watermark and not properly crediting the artist. Commercial commissions are excluded from this rule. e) Purchasing the artwork to feed it into AI-learning softwares of any kind. 4. The commissioner is NOT allowed to claim the artwork as their own. This includes removing the watermark on the artwork. In cases where the watermark doesn’t show (e.g., the artwork was cropped to be used as an icon or other), the commissioner must find a way to credit the artist nonetheless. Commercial commissions are excluded from this rule. 5. The commissioner has permission to reupload the artwork on their social media accounts, or have it printed for personal use. In this case, the artist must be credited and the watermark must stay intact. 6. The commissioner is not allowed to heavily alter the artwork. Some alterations, such as cropping or applying filters, are allowed. 7. If the commissioner asks for a sketch or a lineart, only the commissioner has the right to trace over or color in the artwork. It may not be handed over to another artist to “finish.” Again, credit must be provided and the watermark must stay intact. Payments and Refunds 1. The commissioner is expected to pay the full payment of the arranged price before the artist proceeds with their commission. The artist will NOT proceed with the commission if the arranged payment isn’t given. (Payment-Plans are possible after discussion.) 2. The commissioner has a maximum of ONE (1) WEEK to pay the full price before the start of the artwork. Any exception to this rule must be previously discussed and agreed upon by both the artist and the client. 3. The commissioner is encouraged to send a proof of payment to the artist regardless if an invoice was given or not. This will help the artist keep track of any and all payments done. 4. Refunds will only be provided if the commissioner cancels during the EARLY stages of progress. • 100% non-progressed artwork • 50% sketch , lineart Otherwise, there will be no refunds granted, even if the commissioner cancels their order. 5. If the artist is the one to cancel the commission due to their inability to complete it, a FULL refund will be given. 6. The artist is open to negotiations regarding prices, but a minimum will be provided so as to retain the integrity of the artist’s services 7. The artist has 30 business days to complete the project. If they are unable to meet their personal deadline, a full or partial refund will be offered based on completion. Communication 1. The commissioner may contact the artist on their social media accounts at any time of day. Please give the artist some time to respond, as they may be busy or asleep when the message is sent. 2. Requesting for exceptions on any of the rules mentioned in this ToS may be discussed with the artist first. The artist reserves all right to decline if they think the request is unreasonable and not made on valid grounds. 3. The commissioner MUST provide either of the following before ordering a commission: a) A reference sheet or reference photos for the character(s)/setting(s) that they are asking for, as well as additional images for poses, backgrounds, sceneries, etc. b) A detailed description of the character/setting that they are asking for, as well as additional details for poses, backgrounds, sceneries, etc. An exception to this rule can be made if the artist is already familiar with the characters that the commissioner requests for. 2. A WIP may be requested if the commissioner wants to check in on the state or current progress of their commission. 3. A progress chart will be provided once all slots for a specific batch have been taken. The commissioner may use this to keep track of their commission. This is for batch commissions only. 4. The time of completion of the artwork may reach up a months due to the artist’s present health conditions and busy schedule. Please be patient as the artist will do everything in their power to deliver the artwork in no more than a months. (Long-term commissions are exceptions.) 5. Any edits or revisions must be done during the sketch approval stage. Any edits requested after the Lineart and Color stage may incur an additional cost depending on the artist’s progress on the specific artwork. NO revisions will be made after the artwork is complete. a) If the commissioner wants an exception to this rule, they must be prepared to pay atleast 30% and at most 70% of the original price for the edits. The fees will vary depending on the amount and complexity of changes to be made. 6. If the artist commits an error (with proper proof and basis), the artist will make any appropriate change with no additional cost.
